O R D E R

% 09.05.2016 The petitioner is aggrieved by the two orders i.e. the order dated 26.03.2014 and the subsequent order dated 22.12.2014. By both the order, a cumulative costs of Rs.30,000/- had been imposed upon the petitioner. The petitioner is the sole contesting defendant in the Trial Court. Out of this costs of Rs.30,000/-, Rs.10,000/- was directed to be deposited with Delhi High Court Legal Services Committee and Rs.10,000/- had to go to Prime Minister's Relief Fund and Rs.10,000/- was directed to be given to the plaintiff. Contention of the petitioner is that this cost was not only excessive but was not called for for the reason that the suit had been remanded back and opportunity had been granted to the plaintiff to lead his evidence on the valuation clause; the petitioner who was the sole contesting defendant had only sought permission to cross-examine the witness which was his legal right as such the costs should not have been imposed.

Noting the above factual matrix, this Court is of the view that the interest of justice would be served if the cumulative costs of Rs.30,000/- is reduced to Rs.10,000/- and the costs of Rs.10,000/- directing payment to the Delhi High Court Legal Services Committee and Rs.10,000/- to the Prime Minister's Relief Fund is set aside. Petition disposed of.
