In the previous bail application filed by the Applicant (BAIL APPLN. 3360/2025), this Court, vide order dated 2nd September, 2025, passed the following directions:

"1. This is the second application filed by the Applicant under Section 483 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 88/2023, registered at P.S. Maidan Garhi for the offences under Sections 376/376D/354/323/498A/34 of the Indian Penal Code, 1860.

2. Mr. Vikram Singh Dalal, counsel for the Applicant, submits that subsequent to the dismissal of the Applicant's earlier bail application [BAIL APPLN. 2159/2023] by this Court on 08th August, 2023, there has been a material change in circumstances. framed. Since then, the trial has progressed, and now the statement of the prosecutrix has been recorded, which, according to him, reveals material contradictions in the case of the prosecution. In view of these developments, he argues that material change in circumstances entitles the Petitioner to apply for bail afresh.

3. Accordingly, Mr. Dalal seeks leave to withdraw the present application with liberty to apply for bail before the Sessions Court.

4. Dismissed as withdrawn with a liberty to the aforesaid.

5. If and when such an application is filed before the Sessions Court, the same shall be considered on its own merits, in accordance with law.

6. The Court has not commented on the merits of the case. All right and contentions of the parties are left open."

Subsequently, in light of the liberty granted above, the Applicant filed an application before the Sessions Court, which was rejected by order dated 18th September, 2025.

The Applicant, accordingly, approached this Court. 4.

After addressing submissions for some time, Mr. Vikram Singh Dalal, counsel for the Applicant, states that he would like to withdraw the present bail application.

Dismissed as withdrawn.
