The present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (corresponding to Section 439 of the Code of Criminal Procedure, 19732) seeks interim bail in the proceedings arising from FIR No. 195/2024 dated 13th February, 2024, registered under Sections 302/34 of the Indian Penal Code, 18603 at P.S. Samaipur Badli, on medical grounds.

Officer, Dispensary, Central Jail No. 10, Rohini, Delhi, it appears that the Applicant has refused to undergo surgery due to apprehensions regarding post-surgery care, as the facility for a special caretaker is not available in the jail dispensary.

Counsel for the Applicant submits that this concern has caused a delay in the Applicant's treatment.

In view of the above, the present bail application is disposed of with a direction to the Jail Superintendent to ensure that the Applicant is provided treatment at an outside hospital, such as Deen Dayal Upadhyay Hospital or the All India Institute of Medical Sciences, Delhi, whichever is suitably equipped.

The Court expects that all necessary medical care and treatment shall be provided to the Applicant without any further delay. 6.

With the above directions, the application is disposed of along with pending application(s).

Copy of the order be sent to the concerned Jail Superintendent, for necessary information and compliance.
