Petitioners have assailed order dated 04.04.2025 of the learned trial court, whereby application under Order VIII Rule 1 CPC was dismissed because despite service of summons on 22.05.2023, the Written Statement was filed on 27.02.2025, without any cogent reason explaining the delay. Rather, the application under Order VIII Rule 1 CPC in itself does not seek any condonation of delay in the prayer clause. 2.

After addressing partly, learned counsel for petitioners on instructions of his clients present in Court, seeks permission to withdraw this petition. 3.

As requested, the petition and the accompanying applications are dismissed as withdrawn.
