By way of this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks grant of regular bail in connection with FIR No. 112/2021 dated 16.02.2021, registered at Police Station Mangol Puri, Outer District, New Delhi, under Section 302 of the Indian Penal Code, 1860.

Ms. Manjeet Arya, learned Additional Public Prosecutor, states at the outset that, three public witnesses, being the family members of the deceased, are yet to be examined, and that the report of the Forensic Science Laboratory ["FSL"], with regard to blood sampling, is awaited. She submits that the FSL has not submitted the report despite reminders. 3.

with liberty to the applicant to move the learned Sessions Court at the appropriate stage. However, he seeks a direction for expedition of the FSL report and recording of the testimony of the aforesaid three witnesses.

The Investigating Officer is directed to communicate this order to the FSL so that the report is furnished as expeditiously as possible. Having regard to the period of incarceration, the applicant is also at liberty to move the learned Sessions Court for expeditious recording of the evidence of the three witnesses. Ms. Arya assures the Court that the prosecution will cooperate in this regard.

Accordingly, the bail application is dismissed as withdrawn in terms of the above.

It is made clear that this Court has not made any comment on the merits of the case or on any proposed application before the learned Sessions Court, which may be considered by the learned Sessions Court in accordance with law.
