The present application has been filed by the petitioner under Section 151 of the Code of Civil Procedure, 1908 ("CPC"), for clarification of the th final judgment dated 26 September, 2025, passed by this Court.

Learned counsel appearing for the petitioner submits that vide th September, 2025, this Court has granted time to the judgment dated 26 petitioner herein to file an appeal before the Appellate Tribunal Municipal Corporation of Delhi ("ATMCD"), within a period of four weeks. sealed, forthwith.

It is submitted that despite the aforesaid direction, the property of the petitioner has not been de-sealed.

Per contra, learned counsel appearing for the respondent-Municipal Corporation of Delhi ("MCD") submits that the property has not been desealed for the reason that the appeal is yet to be filed by the petitioner before the ATMCD.

Responding to the same, learned counsel appearing for the petitioner submits that the appeal is ready and that the same shall be filed, expeditiously, within the time granted by this Court. 6.

Accordingly, the MCD is directed to forthwith de-seal the premises in question. However, it is clarified that in case, the petitioner does not file appeal before the ATMCD, within the time as granted by this Court, vide order dated 26th September, 2025, the MCD shall be at liberty to re-seal the premises in question, after expiry of the said period, as granted by this Court.

With the aforesaid clarification, the present application is accordingly disposed of.
