The present petition has been filed under Articles 226 of the Constitution of India read with Section 528 of the Bharatiya Naragik Suraksha Sanhita, 2023, seeking following reliefs:- a) Issue a writ of Habeas Corpus or any other appropriate writ, order, or direction directing the Respondents to produce the petitioner's husband, who has been illegally detained since 23.09.2025 at about 1300 Hrs ( 01:00 PM) P.M. by the police officials of P.S. District Special Staff, Rohini Sector 11, before this Court;
b) Pass appropriate orders for immediate release of petitioner's husband from illegal custody;
c) Direct an inquiry against the erring police officials responsible for the illegal detention;

Learned Standing Counsel appears on advance notice. Status Report has been submitted before this Court by the learned Standing Counsel and same is taken on record.

Learned Standing Counsel submits that the detenue was arrested on 22.09.2025 under Narcotic Drugs and Psychotropic Substances Act and was produced before the concerned Special Judge on 23.09.2025. He submits that on 25.09.2025, upon completion of custodial interrogation, detenue was remanded to judicial custody for 14 days.

He further submits that copy of the documents with regard to aforesaid proceedings and the Status Report has been handed over to the petitioner. 5.
Pursuant to aforesaid, learned counsel for the petitioner, on instructions, seeks permission to withdraw the present petition with liberty to file petition before the appropriate forum.

Permission and liberty, as prayed for, is granted in accordance with law.

Accordingly, the present petition is dismissed as withdrawn.
