First Bail Application under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking Regular Bail in Complaint Case No. 34125/2019 under Section 138 of the Negotiable Instruments Act, 1881.

Learned Counsel for the Petitioner submits that the Petitioner was convicted and sentenced in the Complaint Case No. 34125/2019 under Section 138 NI Act. While the Appeal was pending before the Revisional Court, the parties have arrived at a settlement but because the Petitioner was unable to pay the balance amount of Rs.1,20,000/-, the learned Sessions Court upheld the conviction and remanded the matter to the Court of learned JMFC for compliance. Consequent to that, NBWs were issued and the Petitioner has been arrested on 19.09.2025.

The Petitioner has already filed the Revision Petition before this Court challenging the conviction and the sentence.

From the submissions made, it is evident that it is technically a suspension of sentence, which has been sought by the Petitioner for which, he is at liberty to move the appropriate Application in the said Revision Petition.

The present Bail Application is not maintainable and is accordingly disposed of alongwith pending Application.
