Second Bail Application under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 ("B.N.S.S.") has been filed on behalf of the Applicant for grant of Interim Bail in FIR No.0476/2022 under Sections 186/353/307/34 IPC and Sections 25/27 of Arms Act, registered at PS: Civil Lines, Delhi, for six weeks on the ground of medical condition of his wife, who is HIV patient and her surgery for gall-bladder is scheduled for 10.10.2025. 4.
Issue Notice. Learned counsel for the State appears on advance Notice. 5.
In support of the assertions, medical documents of the wife have been annexed. It is further submitted that in another FIR No.0468/2022 under Sections 392/397/411/34 IPC, registered at PS: Civil Lines, the Applicant has been granted Interim Bail for 10 days for the same purpose. Learned APP for the State submits that the Applicant is involved in other cases and also that he is an accused in an offence under Section 307 IPC by attempting to kill a Police officer with gun-shot. Moreover, he has two brother and other family members to take care of his wife. Submissions heard and record perused 7.
Record shows that on the similar grounds, Interim Bail had been granted by the learned ASJ vide Order dated 02.08.2025, but he could not be released, as he was denied Interim Bail in the FIR No.0468/2022. The medical record shows that his wife is suffering medical ailments. 8.
Considering the medical documents and previous record, the Applicant is granted Interim Bail for ten days w.e.f. 07.10.2025, upon his furnishing a personal bond in the sum of Rs.10,000/- with one surety of the like amount, to the satisfaction of the learned Trial Court and subject to the following conditions:- a) Applicant shall not leave Delhi/NCR without prior permission of the Court;
b) Applicant shall appear before the Court as and when the matter is taken up for hearing;
c) Applicant shall provide his mobile number and also the mobile number of his wife/surety to the IO concerned, both of which shall be kept in working condition at all times and he shall not change the mobile numbers without prior intimation to the Investigating Officer concerned;
d) Applicant shall inform the IO and the Jail Superintendent (not) the address where he shall be available in Delhi; e) Applicant shall not indulge in any criminal activity and shall not The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
communicate with or come in contact with the witnesses; and f) Applicant shall not stay near the complainant and shall not threaten the complainant and the other witnesses in any manner. 9.
However, in case, surgery of his wife is not performed on 10.10.2025, then the Applicant shall surrender on 11.10.2025. 10.
The Interim Bail Application is accordingly disposed of. Pending Application, if any, also stands disposed of. 11.
A copy of this Order be forwarded to the Jail Superintendent for information.
