quashing of FIR No.612/2025 dated 01.08.2025 under Section 115(2)/110 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as „BNS‟) registered at Police Station Mukherjee Nagar, Delhi and all the consequential proceedings emanating therefrom, in terms of the Settlement dated 15.09.2025.

On advance Notice, learned Standing Counsel (Crl.) has appeared and accepted the Notice on behalf of the State.

It is submitted that the Petitioners and the Respondents are all students and had some fight over a seat in the library in which they all received simple injuries.

Brief facts of the case are that the Respondent No. 2, Mr. Aditya Dalal is a research student and lives in Indira Vihar Colony, Mukherjee Nagar. He was studying in the Library (Uday Library) in Indira Vihar. The boy, namely, Aman Chaudhary, came to the Respondent No. 2 and abused him and asked him to move any seat. When the Complainant objected, he along with his friend started fighting with him. Thereafter, a physical altercation ensued. The Complainant filed a Complaint in the Police Station with his friend, namely, Mr. Parvinder, his colleague, Mr. Vikas and his younger brother, namely, Mr. Shivansh about the incident, when he was ambushed near the library. Thereafter, Aman Chaudhary and five or six of his friends, attacked the Complainant and his friends and brother, with hockey sticks, bats and sticks. The Complainant, his companions and his younger brother, were severely injured by repeated blows to the head and legs. They continued to beat the Complainant even after the Complainant fell down. 8.

No.612/2025 dated 01.08.2025 under Section 115(2)/110 and 3(5) B.N.S., got registered at Police Station Mukherjee Nagar, Delhi. 9.
It is stated that the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement dated 15.09.2025. Their 'No Objection Certificate' are annexed on the record. In the Settlement, it was inter alia settled between the parties that there is no subsisting grievance or claim against each other. It is also settled between the parties that they shall not claim or initiate action against each other arising from this incident, either now or in the future. 10.
Today, the Respondent No. 2/Complainant, who is present in the Court, states that he has no objection if the said FIR is quashed. 11.
The parties are present before this Court in-person today, and have been identified by their Counsel and Investigating Officer concerned and they have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 12.
Considering the nature of the allegations and that they have settled the matter, the FIR No.612/2025 dated 01.08.2025 under Section 115(2)/110 and 3(5) of B.N.S., registered at Police Station Mukherjee Nagar, Delhi and all the consequential proceedings emanating therefrom are quashed. 13.
The Petition is disposed of accordingly.
