Petition under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 read with section 482 Cr.P.C. has been filed by the Petitioner seeking quashing of FIR No. 0441/2019 registered under Sections 363/366/376 IPC and Section 6 POCSO Act at P.S. KN Katju Marg, Delhi and all the proceedings emanating therefrom in terms of the Settlement dated 15.01.2025.

It is stated that on 17.11.2019, on the basis of complaint filed by the Complainant/mother of the Prosecutrix, FIR No. 0441/2019 was registered under 363/366/376 IPC and Section 6 POCSO Act at P.S. KN Katju Marg wherein the Petitioner was implicated.

The Affidavit has been filed on behalf of the Prosecutrix, who has stated that she has got married to the Petitioner on 23.08.2021 and one daughter was born from the said wedlock on 18.10.2022. 5.

The Prosecutrix states that she is living with the Petitioner peacefully as husband and wife and does not want any criminal proceedings and states that the FIR may be quashed. The mother of the Prosecutrix endorses that the parties have been living together after having got married. 6.

Learned Counsel for the Petitioner submits that the parties have been happily living together and no grievance against each other survives and since Respondent No. 2 has already made a statement before the Court that she does not want to pursue the proceedings in FIR No. 0441/2019, the present Petition be allowed and FIR registered against the Petitioner be quashed.

Considering the totality of circumstances, FIR No. 0441/2019 registered under Sections 363/366/376 IPC and Section 6 POCSO Act at P.S. KN Katju Marg and proceedings emanating therefrom are hereby quashed.

The present Petition alongwith pending Application, is accordingly disposed of.
