In view of the objection raised by Ms. Puja S. Kalra, learned Standing Counsel for the respondent-MCD, we are of the view that even if the petitioners hold the Certificate of Vending (in short, 'COV'), that by itself would not permit them to carry out such activity in a non-vending area. 2.

The petitioners are required to conduct themselves strictly in accordance with the terms of 'COV', so also the provisions of The Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014.

However, we deem it appropriate to consider and grant the request of the petitioners to the extent of observing that since the petitioners hold a 'COV', which permits them to use a gas cylinder/fire, they cannot be termed as mobile vendors.

to open proceedings for modification of the said condition in accordance with law.
