The present writ petition has been filed against the sealing action undertaken by the respondent no. 1, i.e., Municipal Corporation of Delhi th September, 2025, in respect of the property bearing Plot ("MCD"), on 08 No. 27, Shree Colony, Village Meethapur, Badarpur, New Delhi-110044, without issuance of any notice and in complete violation of the Principles of Natural Justice.

Learned counsel for the petitioner submits that the petitioner is a small-scale businessman, running a glass cutting and fitting unit under the name and style of "SAF INDIA GLASS", and was merely using the said premises as a godown for storage of fragile glass sheets. Additionally, the property in question has no electricity connection and no industrial or commercial activity was being carried out therein by the petitioner. 3.
It is submitted that on 08th September, 2025, the officials of respondent no. 1, accompanied by Delhi Police personnel, illegally entered the premises, ransacked the godown, caused damage to the stored glass, and thereby, sealed the premises without serving the requisite documents to the petitioner.

Learned counsel for the petitioner submits that despite repeated visits to the office of the MCD, the petitioner was neither informed of the reasons for sealing nor was he provided with any documents relating thereto. 5.
It is further submitted that the action of sealing undertaken by the MCD is ex-facie illegal and is violative of the Principles of Natural Justice. Moreover, the impugned action of the MCD has not only caused serious risk to the livelihood of the petitioner, as well as his workers, but may also result in permanent damage to the fragile glass materials lying inside the sealed premises.

It is the case of the petitioner that since no notice or sealing order has been furnished or served by the respondent no. 1, the petitioner is only assailing the sealing action undertaken on 08th September, 2025 by the MCD, in respect of the property in question.

Learned counsel appearing for the petitioner submits that he has approached the Court since there is no Presiding Officer in the Appellate Tribunal MCD ("ATMCD"), as of now.

He, thus, submits that the property of the petitioner be de-sealed for some time, to enable the petitioner to remove the goods from therein and shift the same to any other alternative place. 9.
Responding to the present petition, learned counsel appearing for the MCD submits that action with respect to the property in question has been taken after following the due procedure.

She further submits that the requisite documents have already been provided to the petitioner. However, she has no objection to provide further documents to the petitioner.

Accordingly, it is directed that the property of the petitioner, i.e., Plot No. 27, Shree Colony, Village Meethapur, Badarpur, New Delhi-110044, shall be de-sealed by the MCD, for a period of 10 days, i.e., from 30th September, 2025 to 10th October, 2025, in order to allow the petitioner to remove the goods lying therein. Thereafter, after a period of 10 days, the MCD is free to re-seal the property in question. 12.
The requisite documents pertaining to the action taken by the MCD, shall be provided to learned counsel for the petitioner on the E-mail address, which is reflected in today's order.

The petitioner is granted liberty to approach the ATMCD to file requisite appeal before it.

Needless to state that rights and contentions of both the parties are left open.

It is clarified that this Court has not expressed any opinion on the merits of the case, which shall be considered by the ATMCD, independently.
