The petitioner challenges the order dated 20.02.2024, pursuant to which the cross examination of the respondent was deferred till 02.04.2024 on the ground that arrears of interim maintenance had not been cleared.

The petitioner had made various statements before the learned Trial Court as well as the learned Appellate Court about clearing the arrears within a short period of time. 5.

The impugned order was passed wayback on 20.02.2024. On being pointedly asked, the learned counsel for the petitioner submits that the entire arrears have still not been paid. 6.

Considering the above, this Court finds no infirmity with the impugned order. However, in the interest of justice, six weeks are granted to the petitioner to clear the entire arrears. The learned Trial Court is directed to defer the cross examination and fix a date after six weeks from date. 8.

It is made clear that if the arrears are not paid, the learned Trial Court should proceed in terms of the order dated 02.01.2024.
