On the last date, considering the admitted position that the Supreme Court is seized of the matter pertaining to the appointment of an Interim Resolution Professional in respect of the respondent company, learned counsel for the petitioner was granted time to get instructions whether the petition seeking appointment of an Arbitrator by this Court would be maintainable.

Today, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to subsequently move an appropriate petition seeking appointment of an Arbitrator, depending on the outcome of the Civil Appeal No.9425/20I9 pending before the

Hon'ble Supreme Court.

The petition, along with the pending application, is accordingly dismissed as withdrawn with liberty as prayed for. However, keeping in view the fact that it is the respondent which is privy to the proceedings before the Supreme Court, the respondent is directed to give written intimation to the petitioner upon conclusion of proceedings before the Supreme Court.
