Issue notice to non-applicants/respondents.

Mr. Sanjeev Narula, who, appears on advance notice accepts notice on behalf of the non-applicants/respondents. 3.

Except for, prayer clause (i), counsel for the applicant/petitioner says that he does not wish to press the remaining prayers made in the application.

3.1 Mr. Narula does not oppose the prayer in clause (i). 4.

Accordingly, relief sought in prayer clause (i) is allowed. 5.

Mr. Vinay Kulkarni, Chief Engineer will stand appointed as an arbitrator in the matter.

As a matter of fact, this aspect of the matter was observed in the order of this court dated 10.04.2018.

I am told that there was some confusion in the mind of the respondent, therefore, this application was sought to be moved. 8.

Mr. Vinay Kulkarni as noted in order dated 10.04.2018 shall continue with the proceedings from the stage at which the matter was positioned before the earlier arbitrator i.e. Mr. K.K. Gupta. 8.1. Since, six weeks were granted via the said order which have expired, time for pronouncement and publication of the award is extended till 30.09.2018.

The application is accordingly disposed of.
