By way of the instant application, the applicant seeks grant of anticipatory bail in case arising out of FIR bearing No. 11/2025, registered at Police Station Sunlight Colony, Delhi, for the commission of offence punishable under Section 140(3)/115(2)/127(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereafter „BNS‟).

Brief facts of the case, as alleged by the complainant „N‟ are that he had come into contact with accused Sachin Antil in August 2023 through an online platform. In October 2023, Sachin had called him to his residence, where he had sexually abused him. Chandigarh, Sachin had again attempted to sexually abuse him. By the end of November 2023, Sachin had started mentally harassing, verbally abusing, and intimidating the complainant and his family. In December 2023, the present applicant Sahil Antil, brother of Sachin, had allegedly made intimidating calls warning the complainant not to approach the police. In April 2024, Rakshit Antil, cousin of Sachin, had also threatened and harassed the complainant and his family. On 09.08.2024, Sachin Antil, along with Yugal Verma, Rakshit Antil, and Rohit Antil, had forcibly taken the complainant from his home in a white car to a society in Sonepat, where they had attempted to sexually abuse him. During the journey, they had beaten him multiple times and videographed him.

Later, around 8:30 PM, he had been dropped at Ashram Bus Stand, after being warned of dire consequences to himself and his family. On 10.08.2024, the complainant had again received threatening calls from Sachin, Sahil, Yugal, and Rakshit, cautioning him not to disclose anything to the police. On these allegations, the FIR was registered on 09.01.2025.

The learned counsel appearing on behalf of the applicant argues that the present accused/applicant is only the brother of the main accused, who was in a relationship for some time with the complainant. It is argued that as per allegations, the applicant had merely abused the complainant and no other role has been assigned to him. It is also contended that there is inordinate delay in lodging the FIR. Further, it is argued that since the offence alleged against the applicant is bailable in nature and he is also cooperating in the investigation, thus, the present bail application be allowed. 7.

is at crucial stage, and the applicant may influence the witnesses/complainant, if released on bail. Thus, it is prayed that his bail application be dismissed.

This Court has heard arguments addressed on behalf of the applicant as well as State, and has perused the material available on record. 9.

After hearing arguments and going through the case file, this Court notes that the allegations of abduction and sexual abuse have not been levelled against the present applicant/accused. The allegations against him only pertain to intimidating the complainant and threatening him to not disclose the incidents to anyone.

Thus, considering the overall facts and circumstances of the case and also the fact that the present applicant had earlier joined investigation, this Court is inclined to grant anticipatory bail to the applicant. In the event of arrest, he shall be released on his furnishing personal bond in the sum of Rs.10,000/-, with one surety of the like amount to the satisfaction of the SHO/I.O. concerned, subject to him joining investigation as and when asked by the I.O., on the following terms and conditions: i) The applicant shall remain available on the mobile numbers shared by him with the Police.

ii) The applicant shall not leave the country without prior permission of the concerned Court.

iii) The applicant shall not directly or indirectly make an attempt to approach the complainant, to influence the witnesses or tamper with the evidence in any manner.
