Petitioner has assailed order dated 09.06.2025, whereby the learned trial court dismissed his application for adjourning the suit sine die for the reason that FAO 336/2015 is pending before this court. The learned trial court took a view that there is no stay of suit proceedings directed in FAO 336/2015, so there is no reason to adjourn the suit sine die. 2.

After addressing partly, learned counsel for petitioner seeks permission to withdraw this petition with liberty to file appropriate application in FAO 336/2015.

As requested, the petition and the accompanying applications are dismissed as withdrawn with liberty as sought.
