This hearing has been done through hybrid mode. 2.

The present petition under Sections 11/12 read with Section 2(b) of the Contempt of Courts Act seeks following prayers:- "a. Issue appropriate directions to the Contemnors/Respondents to fully comply with the order dated 03.05.2024 passed by this Hon'ble Court, in WP(C) 5079/2023 & CM Appl. 19402/2024 without any further delay, b. Initiate proceedings against the Contemnors/Respondents and to punish for committing contempt of court in accordance with law, c. Any other order(s) which this Hon'ble Court deem fit and proper in the facts and circumstances of the present case, may also be granted in favor of the Petitioner and against the Contemnor/Respondent." 3.

Vide order dated 03.05.2024 in W.P.(C) 5079/2023, the following direction was passed by this Court: - The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

"CM APPL. 19402/2024

1. Learned counsel appearing for the Delhi Development Authority ("DDA") submits that a fresh tender has already been allotted to a contractor for executing the work of maintaining of sewer lines. He further submits that the work has already commenced.

2. However, the aforesaid fact is disputed by learned Senior Counsel appearing for the petitioner.

3. Mr. Ashim Vachher, learned counsel appearing for the DDA also submits that the work shall be completed within a period of eight to ten months.

4. The Statement made by learned counsel appearing for the DDA is recorded and the DDA is held bound by the aforesaid statement.

5. Accordingly, the present application is disposed of by recording the aforesaid statement made on behalf of DDA."

On the last date of hearing learned counsel for the respondent had submitted that necessary approval, with respect to the implementation of the aforesaid order, has to be given by the Department of Irrigation and Flood Department (GNCTD) as well to Delhi Jal Board. 5.

Accordingly, this Court issued notice to Executive Engineer, CD-IX, Irrigation and Flood Department (GNCTD), Sector-15, Rohini, New Delhi - 110085 as well as to Executive Engineer, SDW-XII, Delhi Jal Board, STP, Sector-25, Rohini, New Delhi - 110085.

Today, status report has been handed up in Court by DDA supported by an affidavit from Mr. Mahesh Chand, Superintending Engineer/RCC-3, DDA, care of Madhuban Chowk, Rohini, New Delhi, wherein it has been recorded as under:

"1. That the instant petition seeking initiation of contempt proceedings for alleged intentional violation of order dated 21.04.2023 passed in WP(C) No. 5079/2023 has been filed by Dwarkadhish Residents Welfare Association for construction of the SPS at Block B in Sector 26, Rohini.

2. That it is respectfully submitted that the work of SPS at Sector 26 was started in time. The structure related to construction of Sewage Pumping The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Station (SPS) main sump was also completed in time. However, the work of laying of rising mains could not begin because of non-receipt of relevant permissions from the concerned authority of Irrigation and Flood Control Department, Government of NCT of Delhi, which was required to give permission for laying mains from SPS Sector 26 to STP in sector 25 Rohini.

3. That in above context, DDA had been requesting Irrigation and Flood Control Department, Government of NCT of Delhi for a long time. However, the permission was given only given after the last date of hearing in this matter namely 26.09.2025 pursuant to the notice issued to the said authority by this Hon'ble Court.

4. That it is respectfully submitted that the fresh tender for laying of rising mains were called and the contract was awarded on 27.11.2025. The work shall start soon and will be taken up by adopting various norms with the traffic police, Tata Power Delhi Distribution Limited (Tata Power-DDL], Indraprastha Gas Limited (IGL). Forest Authorities or any other authority as may be required. Electrical & Mechanical installation by electrical wing of DDA are parallelly in progress for timely commencement of SPS. The timeline for completion of work depends upon timely shifting of services in the alignment of rising mains but is expected in April 2026.

That in above circumstances, it is respectfully submitted that order dated 21.04.2023 passed in WP(C) No. 5079/2023 could not be completed in time as there was delay in receipt of requisite permission and then DDA was required to issue a fresh tender. It is respectfully submitted that there has been no international delay in the matter on the part of DDA." 7.

The said status report is taken on record.

In view of the aforesaid report, the present petition is disposed of with directions to DDA to complete the project by April 2026. 9.

In case of non-compliance the petitioner will be at liberty to revive the present petition.
