The petitioner has approached this Court under Article 226 of the Constitution for a direction upon the Municipal Corporation of Delhi ["MCD"], to remove or demolish iron gates located at A-1/1 Street, next to house No. A-1/1 and St. Dominic's Church, Poorvi Marg, Vasant Vihar, New Delhi-110057.

New Delhi-110057 and at both ends of the back lanes between streets A-1 and A-6, A-Block, Vasant Vihar, New Delhi.

Mr. Kapil Dutta, learned counsel for the Municipal Corporation of Delhi ["MCD"], who appears on advance notice, states that the site has been inspected and both gates, at the end of the back lanes between Street A-1 and A-6, have been found to have been installed without permission of MCD. Mr. Dutta states that necessary action in this regard will be taken in accordance with law within the next four weeks. 4.

In view of the above statement on behalf of MCD, no further orders are required in this writ petition, which stands disposed of. 5.

It is made clear that this order has been passed without prejudice to the rights and contentions of any other owners/occupiers of the locality in question. If they have any legal right in respect of installation of the gates, those rights remain reserved.
