As regards the claim of petitioner no.2, as long as he vends in accordance with terms and conditions of the Certificate of Vending ('COV'), we see no reason for the respondents to institute any action against him. 2.

However, we make it clear that in case of any violation of terms and conditions of COV by petitioner no.2, the respondent shall be at liberty to take action in accordance with law.

As regards the claim of petitioner no.1 is concerned, the fact remains that COV dated 06th November 2021, speaks of him being permitted to vend 'food/snacks with gas cylinder/fire'.

made to vend in a mobile manner, particularly by using gas cylinder/fire. 5.

That being so, the condition to the extent of petitioner no.1, asking him to be a mobile vendor cannot be acted upon.

However, we direct respondents to initiate action against petitioner no.1, in case, he violates other terms and conditions of the COV, but for the mobile vending condition.

Petition stands disposed of, accordingly.

Pending applications, if any, are rendered infructuous. 9.
