This petition under Article 226 of the Constitution of India read with Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners seeking quashing of FIR No. 98/2023 registered under Sections 498A/406/34 of the IPC and Section 4 of the Dowry Prohibition Act at Police Station Karawal Nagar, submitting to the effect that the parties have arrived at a settlement.

The petitioner Nos. 1 to 6 and respondent No.2 are present in Court and duly identified by the Investigating Officer. 3.

It is submitted that the petitioner No.1 and respondent No.2 have resolved all their disputes and are living together in peace and harmony as a married couple along with their child.

The affidavit of respondent No.2 is on record. 5.

In reply to a specific Court query, respondent No.2 submits that she does not oppose the prayer made by the petitioners seeking quashing of the present FIR.

Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No. 98/2023 under Sections 498A/406/34 IPC and Section 4 of the Dowry Prohibition Act registered at PS Karawal Nagar and proceedings emanating therefrom are quashed.

Parties shall abide by the terms of settlement. 8.

Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
