This petition has been filed challenging the impugned order dated 02nd May 2024, passed by the Court of Additional Sessions Judge, Fast Track Court, NorthEast District, Karkardooma Court. By the said order, revision petition filed by the petitioner challenging the order dated 24.01.2024 passed by the Court of learned Metropolitan Magistration-01, North East, Karkardooma Courts, was dismissed. 2.
The Metropolitan Magistrate had dismissed the application under Section 464 Cr.P.C. seeking relief for re-entry/re-possession of property bearing 121/A, Main Road, Moujour, and for release of articles belonging to the applicant. 3.
It is noted that the petitioner was acquitted in FIR No. 537/1995, PS Bhajanpura registered under Sections 448/452/323/506/34 of the IPC by order dated 24.10.2013. The request for re-possession has been made after 10 years. There is a civil dispute pending between the family members and the petitioner can always make a request for recovery of possession inter alia under Specific Relief Act,1963, or any other civil remedy.

As regards the goods that were seized by the Investigating Officer, counsel for the petitioner states that due to the passage of time, they may have dissipated and he does not want to claim the same.

Accordingly, no interference is required by this Court with the impugned order.

The petition is dismissed.

Needless to state that petitioner is always at liberty to exercise his rights under civil law.
