The petitioner has filed the present petition under Section 14 and 15 of the Arbitration and Conciliation Act, 1996 (hereafter 'the Act'), inter alia, praying that an arbitrator be appointed to fill up the vacancy caused by Mr Justice Mukul Mudgal, former Chief Justice of Punjab & Haryana High Court.

It is pointed out that Justice Mukul Mudgal (Retired) was appointed as the Sole Arbitrator to adjudicate the disputes between the parties in terms of the order dated 04.11.2016. The said Arbitrator has since recused from the proceedings on account of his other commitments. In view of the above, the Arbitrator is required to be appointed in his place.

This Court, accordingly, appoints Mr Justice Badar Durrez Ahmed, former Chief Justice of Jammu and Kashmir High Court (Mobile No. 7042205786) as a Sole Arbitrator to adjudicate the disputes between the parties.

The arbitration shall be conducted under the aegis of Delhi International Arbitration Centre (DIAC) and in accordance with its Rules as directed by the order dated 04.11.2016.

The parties are directed to appear before the Coordinator, DIAC on 04.04.2018 at 11:00 a.m. for further proceedings. 8.

A copy of this order be forwarded to the Coordinator, DIAC as well as the Arbitrator. The time for making the award is extended by a further period of one year from today.

The petition is disposed of.
