BAIL APPLN. 360/2017 Issue notice. Notice is accepted on behalf of the State. After some arguments, counsel for the petitioner submits that the petitioner would be satisfied if the trial in the case is expedited. Learned counsel submits that the Trial Court has given long dates on account of heavy pendency and the next date is 18.05.2017. This date was given by the Trial Court in November 2016.

This court is conscious of the fact that the workload of the Trial Court is heavy. However in cases where the accused are in custody, the Trial Court is requested to give shorter dates so that the trial could be completed without any delay. The Trial Court shall henceforth give dates keeping the aforesaid aspect in mind.

The prosecution and the accused should also cooperate and not take any undue adjournment. The Trial Court shall not grant any undue adjournment to either of the parties and the prosecution shall summon the witnesses as directed by the Trial Court from time to time. It is informed that only 2 out of 21 witnesses have been examined till date in a period of two years. This position is not acceptable. The Trial Court is directed to complete the recording of the prosecution evidence within the next one year.
