W.P.(C) 6264/2024 This is a writ petition under Articles 226 and 227 of the Constitution of India, inter alia, seeking following reliefs: (a) Issue a writ of mandamus or any other appropriate writ, order or direction, directing the Respondent to give the benefit of ACP/MACP from the date on which the Petitioner completed 20 or 30 years of unblemished continued service and to re-fix the pay of the Petitioner accordingly;

Petitioner financial upgradation from due date and accordingly grant him arrears of salary revised retiral benefits, pensions etc; (c) Issue an appropriate Writ Order or Direction to the Respondent to fix the pay of the Petitioner in eligible and admissible pay scales as per hierarchy after granting financial upgradation under ACP/MACP from their respective due dates in the pay scale with admissible grade pay;

(d) Issue an appropriate Writ Order or Direction to the Respondent to issue revised pension order paying arrears of pension and the arrears of pay, accordingly , on the interest @ 12% p.a. from the date due;

(e) Pass any other appropriate Writ, order or direction keeping in view the facts and circumstances of this case."

Mr. Suman Kumar, learned counsel appearing for the petitioner seeks permission to rectify the prayer clause in the present writ petition and refile the same.

The present writ petition is therefore, dismissed as withdrawn with liberty to file a fresh writ petition seeking correct prayers within one week. The aforesaid liberty is without prejudice to the rights and contentions of the respondent.
