By filing the instant petition, the petitioner is praying for transfer of RCT No.18/16 (now re-numbered as 38/16) titled as 'Sh.Basant Lal Jain Vs. Shri Sultan Singh' pending in the Court of learned District Judge, North West District, Delhi to the Court of District Judge, North District, Rohini Courts, Delhi where the connected appeal RCT No.24/16 titled as 'Sh.Basant Lal Jain Vs. Shri Sultan Singh' in respect of the same property between the same parties is pending.

None has appeared on behalf of the petitioner. 3.

Learned counsel appearing on behalf of respondent fairly concedes that the suit property falls in North District and he has no objection if the appeal pending in the North West District, Delhi is transferred to the Court of District Judge, North District, Rohini Courts, Delhi where another case between the same parties, is pending.

In view of the no-objection given by learned counsel for the respondent, RCT No.18/16 (now re-numbered as 38/16) titled as 'Sh.Basant Lal Jain Vs. Shri Sultan Singh' is withdrawn from the Court of learned District Judge, North West District, Delhi and is assigned/transferred to the Court of District Judge, North District, Rohini Courts, Delhi where the connected appeal RCT No.24/16 titled as 'Sh.Basant Lal Jain Vs. Shri Sultan Singh' in respect of the same property between the same parties is pending, for disposal in accordance with law. 5.

The next date of hearing in RCT No.24/16 titled as 'Sh.Basant Lal Jain Vs. Shri Sultan Singh' pending before the Court of District Judge, North District, Rohini Courts, Delhi is stated to be 26th May, 2017. 6.

Parties are directed to appear before the transferee Court on 26th May, 2017. Case file of RCT No.18/16 (now re-numbered as 38/16) titled as 'Sh.Basant Lal Jain Vs. Shri Sultan Singh' be sent to the transferee Court before 26th May, 2017.

The petition stands disposed of in above terms. 8.
