% 07.03.2017 Present contempt petition has been filed alleging wilful disobedience of the order dated 9th August, 2016, passed by a Division Bench of this Court in W.P.(C) 369/2008 whereby respondents were directed to decide the petitioner's representation for grant of notional benefits within six weeks. In the petition it has been averred that despite the aforesaid order, respondents have not decided the petitioner's representation till date and have instead passed an order dated 14th February, 2017 holding a preliminary enquiry against the petitioner on 1st March, 2017 and directing him to attend the said enquiry.
On 3rd March, 2017, when the matter was taken up for hearing, Mr. S. Rajappa, learned counsel for respondent had stated that the petitioner's
representation had been disposed of. However, as he was not in possession of the said order, matter was adjourned to today. Today in Court, Mr. Rajappa has handed over a photocopy of the office order dated 10th/13th February, 2017 by virtue of which the petitioner's representation has been disposed of. The same is taken on record.
Keeping in view the aforesaid, present contempt petition and pending application are dismissed.
