% 09.07.2018 The prayer in the petition is for quashing the proceedings arising out of FIR no.143/2013 under Section 420, 468, 471, 34 Indian Penal Code, 1860 of PS Palam Vilage. The learned Additional Public Prosecutor points out that it is not simply a private dispute between the petitioner (accused) on one hand and the second respondent (complainant) on the other in as much as the investigation has brought to light that on the basis of forged documents (title deeds) relating to an immovable property of the complainant, the petitioner had fraudulently obtained loan from Central Bank of India, Shalimar Bagh.
The petitioner and the second respondent may have come to an understanding between them but it cannot be ignored that the case involves economic offences concerning financial and economic wellCRL.M.C. 1117/2016
being of the State with implications that go beyond the domain of a mere dispute between private disputants and, thus, it is not a fit case where prayer for quashing of the criminal case ought to be entertained by this court. [see Parbatbhai Aahir Vs. State of Gujarat, (2017) 9 SCC 641] Dismissed.
