By this petition, the petitioner seeks bail in case FIR No. 132/2017 under Sections 328/376/506/120B/34 IPC and Section 4 and 17 of the Protection of Children from Sexual Offence in short 'POCSO Act'. 2.
The above noted FIR was registered on the written complaint dated 12th March, 2017 for an alleged incident dated 19th March, 2016 wherein the prosecutrix alleged that on 1st March, 2016 she received a friend request on her phone from the petitioner which she accepted. On 19th March, 2016, girlfriend of the friend of the petitioner came to her and asked her that she will facilitate the meeting with the petitioner so she accompanied the said girl to the house of the petitioner where she was offered cold drink. taking the same she became unconscious and when she regained consciousness, she found herself in the house of the petitioner and nobody except her and the petitioner was there and the petitioner had committed wrong act with her. The petitioner also snatched her mobile phone, broke the same and told her that he will marry her after two years. She, however, did not lodge any complaint at that stage. After nearly one year when she saw the petitioner's photograph with a girl thereafter she lodged a complaint. 3.
The prosecutrix has since been examined before the learned Trial Court. Petitioner is in custody since 12th March, 2017. Completion of the trial will take some time. Thus without commenting on the merits of the case , this Court deems it fit to grant bail to the petitioner. 4.
It is, therefore, directed that the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount, subject to the satisfaction of the learned Trial Court, further subject to the condition that the petitioner will not leave the country without prior permission of the Court concerned and in case of change of residential address the same will be intimated to the learned Trial Court concerned by way of an affidavit.
