W.P.(C) 1916/2017 Petitioner is aggrieved by the illegal and unauthorized construction purported to have been carried out by the private respondent namely respondent no.2 at property bearing No.R-10A, Khirki Extension, Malviya Nagar, New Delhi.
On advance notice, learned counsel for respondent no.1/SDMC
has put in appearance. His submission is that the correct number of the property is R-11 and not R-10A. This number has been recorded. It is stated that from ground floor to fourth floor illegal deviations have been noted; the same have been booked on 01.12.2016. Work stop notice has been sent to the SHO on 16.12.2016. Prosecution under Section 466A of the DMC Act has also been initiated. Learned counsel for respondent no.1 under instructions states that all actions which have been initiated shall be taken to its ultimate goal. This statement of respondent no.1 is taken on record. It is hope and expected that this commitment of respondent no.1 to this Court shall be honoured in true letter and spirit. Needless to state that assistance of local police/respondent no.3 shall be obtained by respondent no.1 as and when needed. All adverse action will be after due notice to the respondent no.2/private respondent. No further orders are called for in this petition. Petition disposed of.
