This is a petition for grant of probate/letters of administration. However, the name of the testator, mentioned in prayer clause, is incorrect. The pleadings are also incorrect with regard to the date of death of the testator, who is the petitioner's grandfather [paragraph 5]. The dates of death of the petitioner's parents, which are mentioned in the list of dates, are missing in the petition, and unsupported by documentary evidence.

Mr. Paras Aneja, learned counsel for the petitioner, is permitted to withdraw this petition, with liberty to institute a fresh petition on the same cause of action with proper averments, documents and prayers. 3.

The petition, alongwith all pending applications, stands dismissed as withdrawn, with liberty as aforesaid.
