Writ Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner with the following prayers:- "a. Issue a Writ of Mandamus, or any other apposite writ, order or direction commanding the Respondents herein, to provide adequate protection to the Petitioner by ensuring that no hindrance, obstruction, or intimidation, is caused to him in the discharge of his lawful religious duties as the hereditary Sajjada Nashin of the Dargah of Hazrat Khwaja Baqi Billah (R.A.), situated at Eidgah Road, Paharganj, New Delhi; and to further direct that the benefit of the protective directions already issued by The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

this Hon‟ble Court in Orders dated 17.08.2020, 21.02.2024 and 19.08.2025 in favour of the Petitioner‟s brother (Imam of the said Masjid) be extended to the Petitioner as well, considering that the premises, threats and encroachers being identical, and the nature of duties being analogous in character; and b. Issue a Writ of Mandamus, or any other analogous writ, order or direction commanding Respondent No.

3, the Deputy Commissioner of Police (Central District), to personally supervise and ensure the strict implementation of Prayer (a) made hereinabove by framing a Standard Operating Procedure (SOP) or issuing apposite standing instructions for compliance within his jurisdiction, so as to translate the protective directions into effective ground-level enforcement, necessitated in view of the repeated and persistent non-compliance by the local police of earlier orders of this Hon‟ble Court dated 17.08.2020, 21.02.2024 and 19.08.

2025 (passed in favour of the Petitioner‟s brother, the Imam of the said Masjid), and to further ensure that any breach, neglect or wilful default in compliance is visited with immediate disciplinary and legal consequences against the delinquent officials; and (c) Pass any other further order, which this Hon‟ble Court may deem fit and proper in the facts and circumstances of the present case."

It is submitted that the brother of the Petitioner has already been provided with the Protection vide Order dated 17.08.2020. A Contempt was filed in which again, the Order of Protection has been reaffirmed vide Order dated 21.02.2024. Another Petition was filed in which, the Protection Order has again been given on 19.08.2025.

It is submitted that the Petitioner also has similar threats and seeks Protection.

Learned Counsel on behalf of the State has no objection in providing the security.

It is pointed out that phone number of the Beat Officer has been provided to the Petitioner and the Petitioner is permitted to call the Beat Officer or any other Senior Officer in case he apprehends any breach of peace or threat to his life and liberty.

Petitioner is at liberty to approach the Senior Officers in case he feels any threat to his life and liberty or in case he apprehends any breach of peace.

The present Petition alongwith pending Application, is disposed of in the aforesaid terms.
