By this petition the petitioner seeks parole and challenges the communication dated 16th January, 2018 rejecting grant of parole to the petitioner on the ground that there may be an adverse impact on law and order situation, the petitioner may jump the parole and there is no compelling reason to grant parole as Special Leave Petition can be preferred from jail itself.

On a notice being issued verification has been done and a status report has been filed. During the course of verification statements of mother and wife of the petitioner were recorded. As per the verification report, petitioner has roots in the society with his residential address being P-114, Lane No. 2, Abdul Hamid Road, Batla House, Jamia Nagar, Delhi. Learned Standing Counsel for the State on instructions states that the family of the W.P.(CRL) 715/2018

petitioner comprises of his mother, wife and three children. 3.

The nominal roll indicates that the petitioner was on regular bail by this Court pending hearing of the appeal from 11th January, 2002 and 5th September, 2017.

Considering the fact that there is no other involvement of the petitioner, after the appeal was dismissed by this Court the petitioner surrendered to custody and that the petitioner has roots in the society, this Court deems it fit to grant parole to the petitioner. 5.

It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court/CMM concerned. 6.

Petition is disposed of.

Copy of the order be communicated to the petitioner through Superintendent, Tihar Jail.
