% 11.05.2018 Learned counsel for the petitioner submits that PW1 Mahender Singh, PW6 Jaswinder Singh and PW10 Amrik Singh were eye-witnesses. They have already been examined.
None of them have identified the petitioner in Court. They have been declared hostile. They were cross-examined by the learned APP but nothing could be elicited from them with regard to the role of the petitioner.
He submits that there is no other circumstantial evidence against the petitioner.
Petitioner is in custody for more than four years.
Learned APP submits that petitioner has handed over his clothes to the Investigating Officer during the investigation, which contains blood. Learned counsel for the petitioner submits that clothes were allegedly recovered after four days.
Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms. Dasti.
