CORAM:
HON'BLE MS. JUSTICE MUKTA GUPTA
O R D E R
% 11.04.2018 By this petition, petitioner seeks parole and also challenges the communication dated 24th January, 2018 whereby the application of the petitioner for grant of parole on the ground to file SLP before the Hon'ble Supreme Court, to be with the daughter in her final exams of LLB, to admit her son in 8th standard and to maintain social ties was declined for the reason as per the nominal roll, the conduct of the petitioner in the last one year was unsatisfactory and a punishment was awarded to the petitioner on 27th November, 2017.
A perusal of the nominal roll reveals that petitioner was awarded punishment for stoppage of canteen facility for three weeks after appraisal by the District and Sessions Judge vide order dated 27th November, 2017 due to arguing and fighting with other inmate on 25th October, 2017. W.P.(CRL) 1034/2018
Considering that one year period from the last punishment had not elapsed and the fact by now the daughter's exam which were to start on 18th January, 2018 are over besides the son's admission and special leave petition can also be filed from the jail itself, this court finds no ground to set aside the communication dated 24th January, 2018 or grant of parole to the petitioner.
Petition is dismissed.
Copy of the order be communicated to the petitioner through Superintendent, Tihar Jail.
