O R D E R

% 13.12.2024 CM(M) 3743/2024 & CM APPL. 68801/2024 It is submitted by the learned counsel for the parties that both parties have come to an amicable settlement as per following terms and conditions:- 1.

The petitioner shall make a total payment of Rs.78,80,000/- to the respondent.

2.

The payment shall be made in 05 equal monthly installments. 3.

First such installment shall be paid by 20.12.2024, while the rest 04 installments shall be paid by the 10th day of each succeeding months. 4.

Petitioner would be at liberty to withdraw the amount lying deposited with Registry of SCDRC, but only after the first 03 installments are fully paid.

Learned counsels have requested that the petition be disposed of in terms of above settlement.

The statements made by learned counsels for the parties are taken on record.

Petition is disposed of accordingly in terms of the aforesaid settlement with direction that both the parties shall remain bound by the terms and conditions of the settlement and in case of any default of payment, the respondent would be at liberty to enforce execution of decree as per the terms of settlement.
