$~9 *
IN THE HIGH COURT OF DELHI AT NEW DELHI
+ CONT.CAS(C) 293/2014 DELHI DEVELOPMENT AUTHORITY & ANR ..... Petitioners Through:
Mr. Giriraj Subramanium, Mr.Vivek Pathak and Mr. Simarpal Sawhney, Advs.
versus MAINSH GUPTA & ORS ..... Respondents Through:
Ms. Amita Gupta, Adv.
CORAM:
HON'BLE MR. JUSTICE J.R. MIDHA
O R D E R
% 28.01.2016 1.
Learned counsels for the parties submit that the disputes between the parties relates to the liability of DDA to pay the property tax to the Municipal Cooperation. It is submitted that the petitioners' Writ Petition bearing No.7398/2014 relating to the above issue is pending before this Court.
2.
Learned counsel for petitioners submits that the petitioners had earlier filed two Writ Petitions in which there was an interim stay order and the parties were directed to constitute a Committee to amicably resolve the matter. According to the petitioners, the respondents did not comply with the said directions. Learned counsel for the petitioners, however admits that a Committee was constituted under the aegis of Ministry of Urban Development which has taken a view in the matter. Learned counsel for the petitioners further admits that there is an interim order in the pending Writ Petition whereby the impugned notices have been stayed by the Writ Court. 3.
Considering that the impugned notices of the Municipal Corporation
have been stayed by the Writ Court, the Committee has already carried out the deliberations with respect to the contentions of the parties and further that W.P.(C) 7398/2014 with respect to the disputes between the parties is pending before the Writ Court, and the contentions of the parties with respect to the liability of the petitioner to pay property tax have to be considered by the Writ Court, no further orders are warranted in this petition which is hereby disposed of.
