The appellant has filed the present appeal impugning orders dated 21.08.2024, 30.08.2024 and 14.10.2024.

Ms Aishwarya Bhati, learned ASG appearing for the appellant, submits that the present appeal is maintainable as the learned Single Judge has concluded that the Director General of CPWD is in wilful disobedience of the orders passed by this Court. Ms Bhati has drawn our attention to the order dated 21.08.2024.

We find no merit in the said contention. Plain reading of the extracts of the order dated 04.12.2023, which is reproduced in paragraph 2 of the order dated 21.08.2024, indicates that the Court had come to the conclusion that the respondent is prima facie guilty of wilful disobedience of the directions of this Court dated 25.09.2008. show cause notice to the Director General, CPWD to appear before the Court and show cause why he should not be held guilty of civil contempt of court and not be punished accordingly. In view of the plain language of the order dated 04.12.2023, it is evident that no final decision holding the respondent guilty of contempt was rendered. Further, no punitive action has been directed.

In view of the aforesaid observation, the learned senior counsel seeks to withdraw the present appeal while reserving all rights and contentions of the appellant.

The appeal is dismissed as withdrawn. Pending applications are also disposed of.
