Mr. Shlok Chandra, learned Senior Standing Counsel for the respondent has informed the Court that the challenge in the instant writ petition was against the rejection of the petitioner's application under Section 10(23C)(vi) of the Income Tax Act, 1961 to obtain tax exemption on income of non-governmental educational institutes for Assessment Year 2008-09. Therefore the petition has been rendered infructuous. 2.

The petition stands dismissed.
