After hearing arguments for some time, learned counsel for plaintiff/petitioner, without prejudice to his rights and contentions, submits that he does not press the present petition and as observed by learned Trial Court he would move fresh application within two weeks from today seeking summary judgment. 3.

It is though apprised that issues have already been framed. 4.

However, in view of the specific observation and liberty, given by the learned Trial Court itself, as reflected in order dated 21.09.2024, the present petition is disposed of with the direction that, in case, any such application is moved afresh within two weeks from today, learned Trial Court, before proceeding any further with the matter, would consider the above said application and dispose it of in accordance with law.
