HON'BLE MS. JUSTICE ANU MALHOTRA

O R D E R

% 15.03.2018 A fresh status report has been submitted on behalf of the State. On behalf of the appellant it has been submitted that he is not involved in the six cases as ascertained on behalf of the State and there is no such FIR i.e. FIR No. 192/2001, PS Harsh Vihar, under Section 379 Indian Penal Code, 1860 and that he has been acquitted in four cases and that only two cases i.e. FIR No. 108/2015, PS Vivek Vihar, under Section 454/380 Indian Penal Code, 1860 and FIR N. 278/2015, PS Vivek Vihar, under Sections 379/457/411 Indian Penal Code, 1860 are in existence against him. On behalf of the appellant it has been submitted that he had gone only once to the building in question for arranging a tutor for his brother's son, in relation to which it has been submitted on behalf of the State that there is no such tuition centre being run. Reliance has been placed on the CCTV footage of the area to show that the appellant allegedly has gone to the spot with hasty steps and has come out from the building during the

time when the complainant was not in the premises from where the goods was stolen.

Taking into account the circumstance of the cases as apparently custodial interrogation is required, there is no ground for grant of anticipatory bail.

The application is declined.

All interim protections are withdrawn.
