W.P.(CRL) 3413/2024 1.

This petition has been filed for assailing the order dated 26th September, 2024 passed by the competent authority rejecting the request for furnishing cash surety by the petitioner.

As per the Nominal Roll, the petitioner has been in custody for 10 years including remissions, has no previous involvements, jail conduct has been satisfactory and has not sought furlough till date. 3.

The furlough was granted by order dated 24th May, 2024 on furnishing two sureties of Rs.10,000/- each along with personal bond, which The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. was modified by order dated 24th July, 2024 reducing it to one surety of Rs.10,000/-. However, the petitioner is unable to furnish surety considering he is separated from his wife and his cousin brother, who used to be sureties earlier, is not inclined to do so.

In these circumstances, the Court is inclined to allow the plea of the petitioner. Petitioner will furnish a cash surety of Rs.10,000/- along with a personal bond, and subject to further condition that he will be resident at his residence indicated in the Nominal Roll, which has been verified by the State.

He shall further report to the local police station in District Darbhanga, Bihar the first and third Monday of every month. 6.

The other conditions imposed by the competent authority will remain the same.

Accordingly, the petition is disposed of with the aforesaid directions. 8.
