O R D E R

% 12.03.2018 Respondent no.2-Dinesh is present in Court and has been identified by ASI Sushil Kaushik of police station Roop Nagar. He submits that he has settled the matter with the petitioner of his own free will and without any undue force, pressure or coercion, therefore, he has objection in case FIR No. 234/2017 under Section 308/34 IPC registered at police station Roop Nagar is quashed qua the petitioner. During the course of hearing, respondent no.2 submitted that petitioner was known to him and a quarrel took place between them on some trivial issue. He further submits that since a compromise has been arrived at between him and petitioner voluntarily he has no objection in case FIR is quashed against him.

Keeping in mind that a settlement has been arrived at between the petitioner and respondent no.2 voluntarily, I am of the view that no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR, which is at the investigation stage, is quashed qua the petitioner. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
