% 15.07.2016 File has been received from the Office of District Judge (South) Saket Courts. I have perused the order dated 04.05.2016 which states that the suit property is situated within the revenue estate of Tikari Kalan which does not pertain to the South District. Perusal of the plaint however shows that the present suit is a suit for recovery of Rs. 40 lakhs paid as earnest money to the defendant. The suit is not for specific performance of agreement to sell. Therefore, no suit property is involved in the present case. The defendant is the resident of Yusuf Sarai which falls within the jurisdiction of South District.

Hence, the Registry is directed to send the complete record of this case to the Ld. District Judge (South), Saket Courts, Delhi for 17th August, 2016. Parties shall appear before the Ld. District Judge (South), Saket Courts, New Delhi on the said date.
