This is a petition filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of an Arbitrator for adjudication of disputes between the parties arising out of the Contract Agreement for design, supply, erection and commissioning of 03 EOT Cranes and 04 Electric hoists dated 28.09.2015. 2.

Mr. Iyer, learned counsel for the respondent states that the Court of Kolkata, India would have the jurisdiction to entertain the petition, while relying upon the Clause No. 12 of the Special Conditions of Contract (SCC).

In this view of the matter, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to approach the competent Court at Kolkata.
