This petition is filed by the Petitioner under Section 11(6) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking appointment of a Sole Arbitration to adjudicate the disputes between the parties. 2.

Learned counsel for the Respondent draws the attention of the Court to the invocation notice dated 16.05.2025 and submits that notice was received only on 02.09.2025 and therefore, this petition was prematurely filed on 15.09.2025.

Faced with this, learned counsel for the Petitioner, on instructions, seeks to withdraw this petition with liberty to file a fresh petition under Section 11(6) of the 1996 Act on the same cause of action. 4.

Petition is disposed of as withdrawn with liberty as prayed for in accordance with law.
