% 25.05.2016 Present writ petition has been filed by the petitioners seeking compensation on account of death of their daughter in the Apron area of Indira Gandhi International Airport.
It is pertinent to mention that the deceased was working as Aircraft Maintenance Engineer-II with Air Deccan Aviation. Since the last three dates of hearing, none has appeared for the petitioner. Though the petition was liable to be dismissed in default, yet this Court on the last few dates orally directed respondent No.2-DIAL, without prejudice to its rights and contentions, to release some compassionate payment to the petitioners.
Mr. Atul Sharma, learned counsel for respondent No.2-DIAL fairly states that the DIAL without admitting any liability and without prejudice to its rights and contentions, shall make a compassionate payment of Rs.5 lacs to the petitioners.
The statement made by Mr. Atul Sharma, learned counsel for respondent No.2-DIAL is accepted by this Court. As a matter of abundant caution, it is clarified that the present order shall not be treated as precedent as it has been passed in the peculiar facts and circumstances of the present case. It is further clarified that the payment of Rs.5 lacs shall not be treated as admission of liability on the part of DIAL. Let the payment be made within a period of two weeks to the petitioners.
