By way of present petition, the petitioner seeks release on parole for a period of 3 months in FIR No.26/1998 registered under Sections 302/201 IPC at P.S. Ambedkar Nagar ,Delhi on the ground of his younger daughter's marriage, which is to be solemnised on 17.11.2024. 2.

Learned counsel for the petitioner submits that the petitioner had earlier approached this Court vide W.P.(CRL) 3201/2024 which was disposed of on 15.10.2024 with an undertaking on behalf of State that the petitioner's representation/application would be decided on or before 25.10.2024. He further submits that the petitioner's representation has remained undecided. He has also referred to the order passed by this Court on 20.08.2024 in W.P.(CRL) 2467/2024 wherein he was directed to be released on parole for a period of two weeks and prays that the order may be passed on similar lines.

Learned Standing Counsel for the State accepts notice and acknowledges that the aforesaid representation has not been decided till date. He, however, on instructions, submits that the factum of marriage of the petitioner's daughter as well as the address of the applicant stands verified.

Considering that despite the aforesaid undertaking, the petitioner's representation has remained undecided and in view of the fact that the factum of marriage stands verified, the petition is allowed and the petitioner is directed to be released on parole for a period of four weeks from the date of his release, subject to his furnishing a personal bond in the sum of Rs.10,000/- to the satisfaction of the concerned Jail Superintendent/ concerned Court/Duty J.M./Link J.M.

The petitioner shall surrender before the jail authorities at the expiry of the period of parole.

The petition is disposed of in terms of the above alongwith the pending application.

Copy of the order be communicated to the concerned Jail Superintendent electronically for information and necessary compliance. 9.
