% 09.05.2017 I.A.No.3638/2017 (u/O 23 Rule 1 CPC) By way of this application the plaintiff informs this Court that he has entered into a settlement with defendant no.2. He seeks permission of this Court to withdraw the suit. Learned counsel appearing for defendant no.8 submits that this permission may be granted subject to the right of defendant no.8 being left open to take up any other substantive proceedings. This prayer is granted. At the same time, permission is granted to the plaintiff to withdraw his suit. Suit is dismissed as withdrawn. Application disposed of.
